FIRE LIMITS

8-1-1: LIMITS DESCRIBED: All that portion of the town contained within the corporate town limits shall be known to be the fire

Manufacture; Sale Prohibited Exceptions, Permits
Storage, Penalty

MANUFACTURE; SALE PROHIBITED: The manufacture of fireworks within the corporate town limits is prohibited unless
the manufacturer is properly licensed with the state. The sale, use, and possession of fireworks is hereby prohibited at all times within the corporate town limits, except for special display purposes, as provided for in section 8-2-2 of this chapter. (Ord., 10-2-2007)

EXCEPTIONS, PERMITS: Upon written authorization secured from the town council, fireworks may be sold and used for
public or private use, and exhibition of fireworks in connection with Flint Creek Valley Days, New Year's, July 4, fairs, carnivals or other celebrations. (Ord., 10-2-2007)

STORAGE, PENALTY: Subsequent to retail purchase, ten
(10) pounds or more of fireworks being stored together, within a five foot (5') radius, must be enclosed in or fully covered by a fire resistant material, until the stored fireworks are used. This said fire resistant material must be preapproved by the town fire chief. Any person or persons, who violate this section, shall be punished by a fine not to exceed five hundred dollars ($500.00) or imprisoned not to exceed six (6) months in jail, or both. CHAPTER 3
OPEN BURNING
SECTION:
8-3-1: Prohibited
8-3-1: PROHIBITED:

Open burning within the town is hereby prohibited, except for proper burning within residences and other supervised buildings, with this prohibition to be in effect during the state fire season as nowset oras may be extended by the state from time totime.

In addition, the burning of garbage within thetownis prohibited at anytime.

Any violation of this section shall be punishable by a fine of twentyfive dollars ($25.00) for the first conviction, a fine of fifty dollars ($50.00) for a second conviction, and a fine of one hundred dollars ($100.00) for any subsequent convictions. (Ord. 1030,9-6-1988)
